Overview: The Family Educational Rights and Privacy Act (FERPA) is a federal law protecting the privacy of student educational records. Parents have certain rights under FERPA, in regards to their child’s educational records, including the right to have access to their child’s educational records, the right to seek to have the records amended, and the right to have some control over disclosures of personally identifiable information from educational records. Once a child reaches the age of 18, or enters a postsecondary institution at any age, rights under FERPA transfer from the parent to the child. The FERPA statute is found at 20 U.S.C. § 1232g, and the FERPA regulations are found at 34 CFR Part 99.

Overview: The Texas Education Agency (TEA) provides a side by side of state and federal special education rules and regulations. The purpose of the side by side is to assist all stakeholders in understanding the federal regulations, including IDEA, the Texas Education Code (TEC), and the Texas Administrative Code (TAC). Comparisons between federal and state laws can be found within the side by side as well.

Overview: The Texas Legal Framework aims to provide and maintain an updated web-based platform for various stakeholders in learning about state and federal laws and regulations. The platform provides resources regarding obligations and rights for the provision of a Free Appropriate Public Education (FAPE) in the least restrictive environment for students with disabilities. Stakeholders may search their local school board policies and operating procedures within The Texas Legal Framework, as well as gather additional information about support networks within the state of Texas, parent resources, and state and national resources. In addition, the Texas Legal Framework provides recent publications like the Notice of Procedural Safeguards, the Parent’s Guide to the ARD Process, and the Special Education Rules and Regulations.
