Overview: Per TEA, the purpose of the corrective action plan (CAP) is to guide LEAs through an in-depth analysis of components contributing to noncompliance, and to develop strategies to create a CAP to resolve noncompliance as identified by the monitoring priorities within the State Performance Plan (SPP) federally required elements and/or by Differentiated Monitoring support (DMS) activities.
LEAs required to develop a corrective action plan due to noncompliance with a SPP indicator, should submit a CAP to the TEA in the TEAL ASCEND application.

Overview: Per TEA, a comprehensive desk review is designed to evaluate the LEA’s performance on all seven critical areas of compliance identified in the diagnostic framework but does not limit the identification of other areas of IDEA non-compliance. LEAs are encouraged to establish internal monitoring processes incorporating the external desk review.

Overview: The Texas Legal Framework aims to provide and maintain an updated web-based platform for various stakeholders in learning about state and federal laws and regulations. The platform provides resources regarding obligations and rights for the provision of a Free Appropriate Public Education (FAPE) in the least restrictive environment for students with disabilities. Stakeholders may search their local school board policies and operating procedures within The Texas Legal Framework, as well as gather additional information about support networks within the state of Texas, parent resources, and state and national resources. In addition, the Texas Legal Framework provides recent publications like the Notice of Procedural Safeguards, the Parent’s Guide to the ARD Process, and the Special Education Rules and Regulations.

Overview: The following FRE information, in addition to RDA indicators, are used when making annual determination level ratings on LEA performance.
- FRE#1 SPP Compliance Indicators
- FRE#2 Timely Submission of Valid and Reliable Data
- LEAs must submit data that is on time and error free for both the TSDS Child Find collection (SPPI 11 and 12) and the SPP application in TEAL (SPPI 13).
- Any noncompliance found from data submitted for SPPI 11a, 11b, 12, and 13, a corrective action plan would be required.
